The underpayment of wages can now be a criminal offence in Australia. From 1 January 2025, intentionally underpaying an employee’s wages or entitlements can be investigated by Fair Work Ombudsman. If an employer is suspected of criminal underpayment offenses, they can be prosecuted by the Commonwealth Director of Public Prosecutions (CDPP).
